Verlängerung der GDP- und GMP-Zertifikate bis Ende 2022

Auch wenn man anderes erhofft hat, hält die Pandemie uns alle noch eine Weile auf Trab. Dabei spürt man die Konsequenzen nicht nur im alltäglichen Leben, sondern insbesondere auch im GMP- und GDP-Umfeld. Europäische Kommission, Heads of Medicines Agencies (HMA) und die European Medicines Agency (EMA) haben dies zum Anlass genommen, einen aktualisierten Fragen- und Antwortenkatalog zu veröffentlichen (abrufbar unter folgendem Link: https://ec.europa.eu/health/sites/default/files/human-use/docs/guidance_regulatory_covid19_en.pdf).

Nachdem im vergangenen Jahr bereits aufgrund der Reiserestriktionen und damit einhergehenden Schwierigkeiten der behördlichen Inspektionen die Gültigkeit der GDP- und GMP-Zertifikate automatisch bis zum Ende des Jahres 2021 verlängert wurde, wird diese Frist nun nochmals ausgeweitet. Konkret liest man im Dokument folgendes:

In Ziffer 2.2. zu GMP-Zertifikaten für Betriebsstätten innerhalb des Europäischen Wirtschaftsraums wird folgendes Vorgehen festgelegt:

„The validity of GMP certificates for manufacturing/importing sites of active substances and/or finished products in the EEA should be extended until the end of
2022 without the need for further action from the holder of the certificate. This automatic extension does not apply where restrictions on the validity period are
stated in the clarifying remarks of the GMP certificate and does not cover changes in the scope of the GMP certificate (e.g. new buildings, new medicinal products).
The validity of time-limited authorisations/registrations to manufacture/import should also be extended until the end of 2022 without the need for further action
from the authorisation/registration holder. This automatic extension does not cover changes in the scope of the authorisation/registration (e.g. new premises, new medicinal products).

For new sites/facilities in the EEA that have never been inspected and authorised, a distant assessment may be conducted in order to evaluate if the site could be
authorised without a pre-approval inspection. In such cases, it should be indicated that the certificate has been granted on the basis of a distant assessment. Moreover, an on-site inspection should be conducted when circumstances permit. If the outcome of the distant assessment does not permit the granting of the GMP certificate, a clock-stop will be triggered until an on-site inspection is possible.“


In Bezug auf Betriebsstätten außerhalb des Europäischen Wirtschaftsraums liest man folgendes:

„The validity of GMP certificates for manufacturing sites of active substances and/or finished products located outside the EEA should be extended until the end of 2022 without the need for further action from the holder of the certificate, unless the issuing/supervisory authority takes any action that affects the validity of the
certificate. This automatic extension does not apply where restrictions on the validity period are stated in the clarifying remarks on the GMP certificate and does
not cover changes in the scope of the GMP certificate (e.g. new buildings, new medicinal products).

For new sites/facilities in third countries where an inspection is required, and where there is no operational mutual recognition agreement (MRA) or the scope is not covered by the MRA, a distant assessment by an EEA supervisory authority may be conducted. A GMP certificate may be granted depending on the outcome of the assessment. In such cases, it should be indicated that the certificate has been granted on the basis of a distant assessment. Moreover, an on-site inspection should be conducted when circumstances permit. If the outcome of the distant assessment does not permit the granting of the GMP certificate, a clock-stop will be triggered until an on-site inspection is possible.“


In Bezug auf GDP findet sich folgende Einschätzung in Ziffer 2.4:

„In light of difficulties to conduct on-site GDP inspections due to restrictions arising from the COVID-19 pandemic, the validity of GDP certificates should be extended until the end of 2022 without the need for further action from the holder of the certificate.

The validity of time-limited wholesale authorisations should also be extended until the end of 2022 without the need for further action from the holder of the
authorisation. This automatic extension does not apply where restrictions on the validity period are stated in the clarifying remarks on the GDP certificate and also
does not cover changes in the scope of the authorisation (e.g. type of medicinal products or authorised operations).
On-site inspections will be conducted according to risk-based inspection planning, taking into account any restriction due to COVID-19.9.“


Eine entsprechende erklärende Notiz wird in einer Fußnote auf der EUDRAGMDP Datenbank aufgenommen.

Die Bereitschaft die angesprochenen distant assessments durchzuführen ist nach unserer bisherigen Erfahrung eher verhalten. Hintergründe dazu sind u.a. der erforderliche technische Standard, die Erfahrung der Inspektoren, aber auch ein gewisses Misstrauen und die Sorge in Bezug auf einen größeren Zeitaufwand im Vergleich zu einem Vor-Ort-Termin. Aufgrund des Andauerns der Pandemie dürfte aber von den Behörden perspektivisch zu erwarten sein, sich dem Thema etwas offener zu nähern. Schließlich macht die Digitalisierung vor keinem Bereich halt.
